ORDINANCE NO.23-01 <br /> AN ORDINANCE AMENDING CHAPTER 15—UTILITIES OF THE CITY CODE <br /> REGARDING DISCONNECTION PROCESS FOR WATER SERVICE <br /> THE CITY COUNCIL OF THE CITY OF PEQUOT LAKES DOES ORDAIN THAT(new <br /> material is underlined; deleted material is lined out; sections which are not proposed to be <br /> amended are omitted; sections which are only proposed to be re-numbered are only set forth <br /> below as to their number and title): <br /> SECTION 1. Pequot Lakes City Code, Chapter 15—Utilities,Article 2—Water <br /> Regulations, Section 15-2.8—Shut Off For Non-payment Utility Bill, Subsection 2.,is hereby <br /> amended as follows: <br /> 2. Disconnect Policy <br /> A. Subject to Subsection 1 of this Section 15-2.8, a water disconnection notice may <br /> be mailed with the customer's utility billing statement to any customer who is two <br /> (2)months or more delinquent on the customer's account as of March 31st and/or <br /> July 31st. The first disconnection notice shall state the following: <br /> (1) The entire past due amount,the current billing amount due,and the <br /> combined amount due to avoid disconnection of water service; <br /> (2) A statement that failure to pay the combined amount due by the close of <br /> business on the due date may result in disconnection of water service to <br /> the property; <br /> (3) The due date,which shall be the last business day of the following month <br /> (either April or August,respectively); and <br /> (4) The contact information for a City employee, and a statement that the <br /> customer may contact the designated City employee prior to the due date <br /> to discuss a payment plan; <br /> (5) The proposed disconnection date; <br /> (6) The person who is responsible for the delinquent account has the right to <br /> appeal the City staff determination to disconnect service to the City <br /> Council by filing a written request to appeal with the City Administrator. <br /> The appeal must be filed with the City Administrator within ten days of <br /> the date of the notice of disconnection; and <br /> (7) The City may additionally certify delinquent charges to the county for <br /> collection in accordance with Section 15-2.8, subsection 3. <br /> 1 <br />
