City Council Minutes <br /> March 3, 2008 <br /> Page 4 of 9 <br /> THERE BEING NO COMMENTS FROM THE PUBLIC, COUNCIL <br /> MEMBER NAGEL MOVED TO CLOSE THE PUBLIC HEARING. <br /> COUNCIL MEMBER ORASKOVICH SECONDED THE MOTION. <br /> MOTION CARRIED 4-0. <br /> COUNCIL MEMBER RYAN MOVED TO ADOPT ORDINANCE 08-03 — <br /> ORDINANCE NO. 1, FIRST SERIES, AN ORDINANCE ADOPTING A <br /> REVISION AND CODIFICATION OF ORDINANCES TO BE KNOWN AS <br /> THE PEQUOT LAKES CITY CODE. COUNCIL MEMBER NAGEL <br /> SECONDED THE MOTION. MOTION CARRIED 4-0. <br /> 5.3. Police Union <br /> Paul Sandelin, City Attorney, updated the Council on the police union <br /> process. Mr. Sandelin recommended that the City Council use a labor <br /> attorney to work with the City in regard to the contract negotiations. The <br /> Clerk noted that she had checked with the City of Crosslake and they <br /> recommended using Steve Fecker of Johnson, Killen & Seiler. <br /> COUNCIL MEMBER ORASKOVICH MOVED TO CONTACT LABOR <br /> ATTORNEY STEVE FECKER AND MAKE ARRANGEMENTS TO USE <br /> THE LAWFIRM FOR LABOR CONTRACT NEGOTIATIONS. COUNCIL <br /> MEMBER NAGEL SECONDED THE MOTION. MOTION CARRIED 4-0. <br /> Paul Sandelin indicated he would contact Mr. Fecker. <br /> 5.4. Trailside Estates <br /> The City Clerk noted that per Council direction the City Attorney has sent <br /> a formal notice of default and recorded the notice of adverse claim against <br /> the Trailside Estates plat. She further noted that the attorney is working <br /> with the bonding company to resolve the issue of a performance bond <br /> versus a warranty bond. Paul Sandelin noted that according to the <br /> bonding company the original performance bond is still valid; however the <br /> face value of the bond is a reduced amount. <br /> The City Council questioned the ramifications to the developer if the City <br /> should decide to draw on the bond. The City Attorney indicated he would <br /> discuss this with the bonding company. He also noted he would find out <br /> the procedure to draw on the bond should the Council decide to do so. <br /> The Council decided to table this issue until there is more information <br /> provided by the City Attorney regarding the process and ramifications of <br />
