11. The proposed tracts have less than 18% impervious surface coverage (40% <br /> allowed). There is sufficient space on each Tract to manage stormwater onsite. <br /> 12.There are no public streets proposed within the development. <br /> And subject to the following Condition: <br /> 1. Prior to recording of the subdivision the southerly 2 ft of the south deck on"Tract <br /> A"shall be removed(per Note #4 on survey)so the existing structure meets the 10 <br /> ft side yard setback requirement. <br /> All members voted"aye". Motion carried. <br /> 5.2 Colton Makowsky,Applicant <br /> Applicant requests a Metes and Bounds Subdivision <br /> Application No. 22-03 <br /> Mr. Burslie explained the Staff Report. Applicant was present. <br /> Discussion ensued regarding the topography of the property,the condition requiring the <br /> suitability reports for Subsurface Sewage Treatment Systems and plotting of property. <br /> A motion was made by Planning Commission Member Ellering, seconded by <br /> Planning Commission Member Norton,to approve the Metes and Bounds <br /> Subdivision request,based on the following Findings of Fact: <br /> 1. The subject property is properly zoned"Urban Residential". <br /> 2. The lot widths of the proposed parcels both meet the minimum standards for the <br /> Urban Residential zoning classification. <br /> 3. Both of the proposed parcels meet the minimum area requirements for the Urban <br /> Residential zoning classification. <br /> 4. The subject property is vacant. <br /> 5. The subject property is not adjacent to the municipal water and wastewater <br /> utilities. Each proposed parcel appears to have sufficient space for a SSTS and a <br /> deep water well. <br /> 6. The property is suitable in its natural state for the intended purpose and this lot <br /> split would not be harmful to the health, safety, or welfare of future residents or of <br /> the community. <br /> 7. The applicant is not proposing any provisions for water-based recreation. <br /> 8. The proposed lot layout meets the requirements of the ordinance. <br /> 9. The proposed side lot lines are at right angles to the existing road line and the <br /> property line of the adjacent property. <br /> 10.The property contains more than 33-feet of frontage on public right-of-way. <br /> 11. The proposed parcels are adequately sized to manage stormwater runoff onsite. <br /> 12.
