AGREEMENT FOR WASTEWATER OPERATIONS SERVICES THIS AGREEMENT(this"Agreement')is entered into by and between the City of Pequot Lakes,a Minnesota municipal corporation(the"City"),4638 County Road 11,Pequot Lakes,Minnesota 56472,and the Pine River Area Sanitary District("PRASD"),a Minnesota municipal corporation and governmental subdivision formed by the Joint Exercise of Powers in the Control of Water Pollution by and between the Cities of Pine River and Chickamaw Beach, and the Townships of Wilson and Barclay,Cass County Minnesota,2567 246 Avenue Southwest,Pine River,Minnesota 56474(collectively the"Parties"). WHEREAS, PRASD owns and operates a Minnesota Pollution Control Agency(the "MPCA")permitted wastewater treatment facility and collection system(collectively the "Facilities"); WHEREAS,PRASD desires to contract for certified wastewater operator services at the Facilities; WHEREAS,City employs a certified wastewater operator(the`Employee")whose certificate class and number are Class A-63795264&Type IV 63795264; WHEREAS,City is willing to contract with PRASD to provide certified wastewater operator services to PRASD at the Facilities on the terms and conditions contained herein. NOW,THEREFORE,it is mutually agreed by and between the Parties,as follows: 1. PURPOSE OF THIS AGREEMENT 1.1. The purpose of this Agreement is for the Employee to provide limited wastewater operator services to PRASD at the Facilities. City hereby agrees that Employee will provide the services specified herein to PRASD and PRASD hereby agrees and authorizes City to provide such services within its Facilities in accordance with and subject to the terms and conditions of this Agreement This Agreement is made pursuant to Minnesota Statues, Section 471.59. 2. CITY SERVICES 2.1. City will maintain current wastewater operator certificates and all applicable licenses from the MPCA for the Employee during the term of this Agreement. 2.2. City will visit the Facilities twice per week,two hours per visit,in order to inspect and supervise the operations of PRASD's Facilities and to assist PRASD employees to perform such duties necessary to comply with State and Federal law,rules,and regulations applicable to the Facilities,including assisting PRASD employees with completing and submitting all required reports to the State and Federal governments,as applicable(the"services"). City's services shall be limited to those specified in this Agreement. All other duties and responsibilities 1
