CITY OF PEQUOT LAKES, MINNESOTA CITY COUNCIL RESOLUTION 2022-14 AUTHORIZING JOINT POWERS AGREEMENT FOR FIRE SERVICES AND TERMINATING CONTRACT FOR FIRE SERVICES WHEREAS, the City of Pequot Lakes ("Pequot Lakes") and the City of Breezy Point("Breezy Point")(collectively the"Parties"),pursuant to Minnesota Statutes, Section 471.59, seek to enter into a joint powers agreement, dated May 1, 2022 (the "Agreement"),to operate and provide fire protection and rescue services to their respective residents through a joint fire department called the"Pequot Lakes Fire District"("District"); and WHEREAS, the Parties hereto are each authorized by Minnesota Statutes, Section 412.221, Subdivision 17,to provide fire protection,rescue, and medical response services to their residents; and WHEREAS, the Parties have determined that it is mutually beneficial for them to join together to improve the efficiency and effectiveness of fire and emergency services to the public within the geographic service area of the Parties, and specifically,the joint fire department to be created hereby will cooperatively address the Parties' long- term needs for those fire services as defined and authorized by the Agreement; and WHEREAS, the District created hereby will be operated and managed by a Joint Powers Fire Board; and WHEREAS, the Parties correspondingly desire to terminate the current contract for fire services dated May 9,2022,with such termination date to be effective upon the fire services commencement date for the District contained in the Agreement, which will be July 1, 2022. NOW, THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL THAT: 1. The City Council hereby approves the Joint Powers Agreement attached hereto and incorporated herein by reference as Exhibit A and authorizes and directs the Mayor and City Clerk to execute the same and any other related documentation necessary to effectuate the creation and operation of the District with a fire services commencement date for the District of July 1,2022; and 2. The City Council hereby terminates the current contract for fire services between the City of Pequot Lakes and the City of Breezy Point,dated May 9, 2022,with such termination effective 11:59 p.m.,June 30, 2022 commensurate the onset of fire services by the District on the fire services commencement date for the District of July 1, 2022, and authorizes and directs the Mayor and City Administrator to execute all such documentation necessary to effectuate such termination. 1
