I also reviewed the title policy for the City Hall property a copy <br /> of which I received from American National Bank. My understanding is that American National <br /> Bank is financing the purchase of the City Hall property through a lease purchase agreement. <br /> According to the title work and the certificate of survey for the property the 66 foot easement is <br /> for ingress, egress and utility purposes and extends from County Road 11 to the northerly <br /> boundary of the City Hall property. The easement was created when the larger Kinzie Candles <br /> tract was subdivided into the Liberty Tool tract and the tract owned by Ryan Buell as shown on <br /> the attached Certificate of Survey. <br /> Given that the City is currently purchasing the City Hall property pursuant to a Lease Purchase <br /> Agreement with American National Bank and American National Bank is the current fee owner of <br /> the property under this method of financing, we will need American National Bank to consent to a <br /> resolution to be adopted by the City of Pequot Lakes, which would identify and designate <br /> Bergquist Drive as a public street. I would also notify the other property owners that utilize the <br /> current easement (Ryan Buell and Landecker & Associates) that the City intends to designate the <br /> easement as a City Street. Designation of Bergquist Drive as a city street would not negatively <br /> impact the other property owner's use of the easement. I would recommend that the resolution <br /> be recorded with the Crow Wing County Recorder. <br />
