New Business <br /> 5.1 Randy and Nichole Loukota, applicants <br /> Applicants request a Metes and Bounds Subdivision <br /> Application No. 22-04 <br /> Mr. Burslie explained the Staff Report. Applicant was present. <br /> Discussion ensued regarding the deck on the north property(Tract A),Tract A not <br /> having a garage and if there would be space to expand the existing structure, setback on <br /> property and practical difficulty. <br /> A motion was made by Planning Commission Member Ellering, seconded by <br /> Planning Commission Member Caouette,to approve the Metes and Bounds <br /> Subdivision based on the following Findings of Fact: <br /> 1. The subject property is zoned"Urban Residential." <br /> 2. The lot widths of the proposed parcels both meet the minimum standards of 5o <br /> feet. <br /> 3. Both of the proposed parcels meet the minimum buildable area requirements of <br /> 6,250 square feet <br /> 4. The existing dwelling on"Tract A"is considered a"legal nonconforming structure" <br /> because it encroaches the 3o-foot setback from West Sibley Street by 4.5 feet.The <br /> south deck on tract A will be modified (per condition #1) so that it meets the 10 ft <br /> side yard setback requirement to the new property line. The existing accessory <br /> structure on "Tract B" meets the 10-foot setback from Bell Avenue and new <br /> property line. <br /> 5. The subject property is adjacent to municipal water and wastewater. <br /> 6. The property is suitable in its natural state for the intended purpose and this lot <br /> split would not be harmful to the health,safety,or welfare of future residents or of <br /> the community. <br /> 7. The applicant is not proposing any provisions for water-based recreation. <br /> 8. The proposed lot layout meets the requirements of the ordinance. <br /> 9.
