JOINT POWERS AGREEMENT TO PROVIDE FIRE PROTECTION AND RESCUE SERVICES THIS AGREEMENT(the"Agreement")is initially made and entered into this_day of , 2022 by and between the City of Pequot Lakes, a municipal corporation under the laws of the State of Minnesota("Pequot Lakes"), and the City of Breezy Point, a municipal corporation under the laws of the State of Minnesota("Breezy Point"); (collectively hereinafter referred to as the`Parties"). WHEREAS,the Parties hereto are each authorized by Minnesota Statutes,Section 412.221, Subdivision 17,to provide fire protection,rescue,and medical response services to their residents; and WHEREAS, the Parties have determined that it is mutually beneficial for them to join together to improve the efficiency and effectiveness of fire and emergency services to the public within the geographic service area of the Parties,and specifically,the joint fire department to be created hereby will cooperatively address thef Parties' long-term needs for those fire services as defined herein below or as otherwise authorized by this Agreeinent;and WHEREAS, Minnesota Statutes, Section 47149 authorizes two or more governmental units by agreement of their governing bodies jointly to exercise any power common to the contracting parties and provide for a joint board representing the parties to the agreement;and WHEREAS, Pequot Lakes respectively owns firefighting/rescue equipment listed in Exhibit A,which is attached hereto and incorporated herein by reference;and WHEREAS,PetNot Lakes owns a fire station located at 4638 Main Street,Pequot Lakes, MN 56472(the"Pequot Lakes Fire Station"a/k/a"Fire Station#1"), as well as the real property upon which the Pequot Lakes faire Station sits;and WHEREAS, Breezy Point owns a fire station located at 8361 County Road 11, Breezy Point,MN 56472(the`Breezy Point Fire Station"a/k/a Fire Station#2),as well as the real property upon which the Breezy Point Fire Station sits;and WHEREAS,Pequot Lakes presently operates the Pequot Lakes Fire Department with paid on call firefighters;and WHEREAS,fire protection services have previously been provided by Pequot Lakes through the Pequot Lakes Fire Department by means of a service contract between Pequot Lakes, as the service provider,and Breezy Point,as the service recipient;and WHEREAS, the creation of a joint powers agreement will meet the legal needs for the Parties to accomplish the purposes as set forth herein,including but not limited to interaction with the area fire services, Crow Wing County Sheriff's Office and other private and public entities; and Joint Powers Agreement to Provide Fire Services Page 1 of 23
