3. The applicant has provided Title Commitment acceptable to the City <br /> Attorney. <br /> 4. There are no new public improvements or improvements that will <br /> ultimately become public. Therefore,the City Engineer has not reviewed <br /> or commented directly on the Final Plat. <br /> 5. The City has received an independent plat check. In a letter dated <br /> November 22, 2021 from David S. Landecker, Minnesota Licensed Land <br /> Surveyor, #17008,indicates the Final Plat agrees with the Preliminary <br /> Plat. <br /> 6. A financial security is not required as part of this subdivision. <br /> Planning Commission Direction: The Planning Commission should <br /> develop findings to recommend the city council approve or deny the Final Plat. <br /> In general, the, city cannot deny a Final Plat unless the applicant will not or <br /> cannot meet the final platting requirements or the conditions of the Preliminary <br /> Plat approval. The city cannot impose additional conditions that do not fall <br /> directly within the guidelines of the Final Plat or relate directly to conditions <br /> imposed in the Preliminary Plat. <br /> The Commission also has the option to table the Final Plat to obtain additional <br /> information. <br /> Staff Recommendation: Based on the Findings of Fact presented in this <br /> report, the Staff recommends approving the application, subject to the following <br /> condition: <br /> 1.
