AGREEMENT AND CONSENT T4 REMOVAL OF <br />NUISANCE CONDITION <br />THIS AGREEMENT is made by V irgil C_ Dahl, l�ereinafter "Owne�", and the City of Pequot <br />Lakes, a mnnicipal corporation under the laws of the State of Minnesota, hereinafter the "City". <br />The parties represent and affirrn that: <br />WHEREAS, Virgil C. Dahl, is the owner of reai property located at 3952 County Road 17, <br />Pequot Lakes, Minnesota 56472, and legally described as follows: <br />The East 773 feet (as measured parallel with the East line af Lot 4) of <br />that part of Lot 4 iying North of Lone Lake Road Section 10, <br />Township 13b Range 29 <br />Parcel Numi�er 29Q102404.AA0409, hereinafter the "Progerty"; and <br />WHEREAS, the City staff has attempted to work with Owner for numerous years for Owner <br />to remove the nuisance canditions Iocated on the Property and such nuisance condition remains on <br />the Property; and, <br />WHEREAS, Owr�er understands t�at Qwner has t�e right to hire an independent contractor <br />to remove the nuisance condition subject to a11 ap��icable Iaws, ordinaz�ces, codes, regulations and <br />policies, but has chosen to not do so; and <br />WHEREAS, the Owner has �equestecE fhat the City remove the nuisarice eonditions and <br />charge the cost of reinoval against the Property; and <br />WHEREAS, the City is willing to cor�tract for the rer�oval af the rz�isance conditions on the <br />Property, providec� the Owner consents, in rvriting, to said removal and subsequent charge against the <br />Property of the cost of remo�ai and the adminisirative fees attendant therewith. <br />N4W THEREFORE, ihe parties hereto agree to the following terms: <br />1_ Owner hereby consents to the removal of the nuisance conditions located on the <br />Property by the City or the City's designated agent/contractor. Owner understands and <br />acicnowledges tha� tf�e cost of remavaI, a�d the administrative %es attendant therewith, shalZ be <br />charged against the Property. <br />2. The City estimates the total cast to be $5,300, which estimate is based on the <br />foIlowing: $4,100 for retnovaI, $I,dQO for IegaI fees and $20Q for administrative fees. <br />Page l of 2 <br />
