I think the approach the city could take on this <br />would be for the City Council to review the request by Ms. Rathcke and decide if this is a road vacation <br />that the city would initiate. Because both the city and Ms. Rathcke own property that abuts the road she is <br />requesting to be vacated both the City and Ms. Rathcke would need to be part of a petition to vacate <br />initiated by Ms. Rathcke. If the city believes it would be in the best interest of the public to vacate this <br />section of Front Street then it probably makes sense for the City to initiate the process. if the City does <br />not believe that vacating the road is in the best interest of the public then there would be no further action <br />to take and Ms. Rathcke would not be able to bring a petition before the city that the city could act upon <br />because she would not be able to establish that a majority of the property owners (Ms. Rathcke and the <br />City) have joined the petition. <br />If the City Council decides to proceed with initiating the road vacation then we would prepare the <br />necessary documents and have the City Surveyor review the proposal and provide us with an appropriate <br />legal description to use for the road as it does not appear to be a platted road. <br />any questions let me know. thanks. <br />Paul Sandelin <br />SANDELIN LAW OFFICE <br />30849 First Street P.O.
