OR <br />November 23, 2009 <br />Mayor and City Council <br />City of Pequot Lakes <br />4638 County Road 11 <br />Pequot Lakes, MN 56472 <br />Re: Planning Commission Report <br />Dear Mayor and City Council, <br />11 <br />COMMUNITYGROWTH <br />I N S T I T U T E <br />Experts in Small Town Planning <br />The Planning Commission met for their regular November meeting, at which there was one <br />public hearing and other various items on the agenda that were discussed. They are forwarding <br />you one item for your review in this report at this time. <br />i. Rezoning from Light Industrial to Commercial, Application 09-3394, <br />Donald Babinski, applicant. The applicant is requesting a rezoning request from <br />Light Industrial to Commercial for part of the property described as part of the <br />Southwest quarter of the Northeast quarter on the Southeast quarter, Section 15, <br />Township 136, Range 29, Crow Wing County, Minnesota. <br />The property is designated on the Future Land Use Map as Urban Residential. <br />The Planning Commission recommends the rezoning request be approved. <br />The approval was made based on the following findings offact. <br />Findings of Fact: <br />i. The rezoning to Commercial is not consistent with Future Land Use Map, <br />which designates the property as Urban Residential. It is a less intense <br />zone than Light Industrial. <br />2. Rezoning to Commercial is more in keeping with the purpose and intent <br />of the Ordinance than the current classification as it is a less intense <br />zone. <br />3. The surrounding properties are zoned Light Industrial, Commercial and <br />Downtown Mixed Use. Light Industrial, Commercial and Downtown <br />Mixed Use are all compatible with each other. The property is not <br />surrounded by residential zones. <br />4. The Commercial Zone may be established next to the Light Industrial <br />Zone or the Downtown Mixed Use Zone. <br />5. The rezoning to Commercial meets the lot, use, and density <br />requirements. <br />6. The portion to be rezoned to Commercial is the 145.51 feet, more or less, <br />lying west of the east line of Parcel Numbers 29015420oA00oo9 and <br />2901513ooHY0009. <br />If you have any questions, concerns or feedback, please do not hesitate to contact me.
