September 29, 2009 <br />Mayor and City Council <br />City of Pequot Lakes <br />4638 County Road 11 <br />Pequot Lakes, MN 56472 <br />Re: Planning Commission Report <br />Dear Mayor and City Council, <br />FA <br />COMMUNITYGROWTH <br />I N S T I T U T E <br />Experts in Small Town Planning <br />The Planning Commission met for their regular September meeting, at which there were six <br />public hearings and other various items on the agenda that were discussed. They are forwarding <br />you one item for your review in this report at this time. <br />1. Rezoning from Shoreline Residential to Rural Residential, Application og- <br />3267, LeRoy Tulenchik, applicant. The applicant is requesting a rezoning request <br />from Shoreline Residential to Rural Residential for part of the property located at 4316 <br />County Road 168. The applicant also has a metes and bounds request further on the <br />agenda. The rezoning would be for one of the newly created lots should the metes and <br />bounds application be approved. <br />The applicant is proposing Tract B and Tract C with Tract B as the property being <br />requested for the rezone. It would be created as a five acre Rural Residential lot while the <br />remaining, Tract C, would be left as Shoreline Residential (it is located on Sibley Lake a <br />General Development Lake). <br />The properties are designated on the Future Land Use Map as Rural Residential and <br />Shoreline Residential. <br />The Planning Commission recommends the rezoning request be approved. <br />The approval was made based on the following findings offact. <br />Findings of Fact: <br />i. The rezoning to Rural Residential is consistent with Future Land Use <br />Map, which designates the property as Rural Residential. <br />2. Rezoning to Rural Residential is keeping with the purpose and intent of <br />the Ordinance as it will be allowing a non- shoreland property to be zoned <br />consistent with its current use and the Future Land Use Map. <br />3. The surrounding properties are zoned Shoreline Residential and <br />Commercial. Rural Residential and Shoreline Residential are compatible <br />with each other. The Commercial Zone may not be in an area that is <br />completely surrounded by Residential however the zoning to the north <br />and south of the Commercial property is still Commercial. <br />4. The Rural Residential Zone may be established next to the Commercial <br />Zone or the Shoreline Residential Zone. <br />5.
