They are forwarding you <br />three items for your review in this report at this time. A separate report contains the public <br />hearing information regarding the Oppidan requests. <br />1. Rezoning from Rural Residential to Light Industrial, Application 09 -318o, <br />Hunt Technologies LLC, applicant. Hunt Technologies, LLC applied last month to- <br />rezone the property where the former TDS Company was located from Rural Residential. <br />to Commercial. The Planning Commission tabled the application last month to allow <br />time to meet and discuss what should take place since the Conditional Use application <br />was withdrawn as determination was made it was not needed. <br />`' Consistent with the recommendation of Staff and the original zoning that existed on the <br />property prior to the comprehensive rezoning that was done following the adoption of <br />the updated ordinance, the applicants are now requesting the rezoning to be from Rural <br />Residential to Light Industrial. This would allow them to establish a testing facility for <br />the testing of meters. <br />The property was rezoned as part of the city -wide rezoning process at which time it was <br />rezoned from Light Industrial to Rural Residential. When the City conducted the mass <br />rezoning it was not the intention to down zone any properties without the owner's <br />consent. Due to the ownership transition of the property that was taking place at the <br />time, it is evident this was overlooked and they did not want it to be down zoned at that <br />time. <br />The properties are designated on the Future Land Use Map as Rural Residential and <br />Open Space. <br />The Planning Commission recommends the rezoning request be approved. <br />The approval was made based on the following findings of fact. <br />Findings of Fact: <br />i. The rezoning to Light Industrial is not consistent with Future Land Use <br />Map, which designates the property as Rural Residential. It is consistent <br />with the prior zoning and the City's intent to avoid downzoning <br />properties as part of the comprehensive rezoning process. <br />2.
