AGENDA ITEM #9.2 <br /> c:r� of <br /> Pequot <br /> Lakes— - <br /> REPORT TO CITY COUNCIL <br /> Report Prepared by: Tim Houle & Nancy Malecha <br /> Date: June 2, 2020 <br /> Subiect: Maintenance Facility Project— Potential Closeout of Contract <br /> Report: After quite a design process, the City's new Public Works <br /> Maintenance Facility was publicly bid at the end of January 2018. Nine bids were <br /> received. Boser Construction, Inc. (BCI) from Sauk Rapids was the lowest, <br /> responsive, responsible Bidder. The City awarded the project to BCI for their lump <br /> sum bid of$894,000 at their February 5, 2018 meeting. <br /> Per the Bidding Documents / Construction Contract, the Facility was to be <br /> substantially completed (ready for the City to occupy) no later than September 28, <br /> 2018. Final completion was 30 days after substantial completion. During the 2018 <br /> construction season, the Council questioned periods of inactivity at the site. BCI <br /> was advised of these concerns. BCI did not submit a request to extend the contract <br /> time. <br /> After a lot of work at the end of September/beginning of October, we believed the <br /> project was substantially complete on October 12, 2018. Ryan Cross, President & <br /> CEO of BCI signed the attached Certificate of Substantial Completion, but they did <br /> not sign the attached corresponding Change Order No. 1 assessing liquidated <br /> damages of$500 per day for a total of$6,500. <br /> With the lateness of the construction season, final completion of several items <br /> dragged into 2019 and now to today, the most recent being turf restoration in the <br /> infiltration swales and basin which the City is taking care of and one spot with a <br /> roof leak which BCI took care of. <br />
