CITY OF PEQUOT LAKES <br /> RESOLUTION 20- <br /> RESOLUTION ACCEPTING TRAILSIDE PARK DONATION <br /> WHEREAS, the City of Pequot Lakes (City) is generally authorized to accept <br /> donations of real and personal property pursuant to Minnesota Statutes, Section <br /> 465.03 for the benefit of its citizens in accordance with the terms prescribed by <br /> the Donor, and that acceptance of such grant is subject to a resolution of the City <br /> Council adopted by a two-thirds majority of its members, expressing the terms of <br /> the grant in full; and <br /> WHEREAS, a fund-holder from the FM Area Foundation (Donor)wishes to make <br /> a donation to the City of Pequot Lakes for a U.S. Armed Services flag display <br /> around the Veteran's Memorial in Trailside Park (the "Project"); and <br /> WHEREAS, the Donor wishes to provide these grants anonymously with no <br /> acknowledgement or identification of the Donor; and <br /> WHEREAS, the Project is yet to be designed by the City, cost estimates for <br /> design and construction of the Project and the same will be required before the <br /> City Council can approve the Project, determine sufficiency of funding for the <br /> same, and put the Project out for bid for purposes of future construction thereof; <br /> and <br /> WHEREAS, further conversations to determine the process and timeline to carry <br /> out the wishes of the Donor will also be considered in the Project process once <br /> the donation offer is accepted by the City of Pequot Lakes; and <br /> WHEREAS, the Project is subject to subsequent future design, feasibility, <br /> approval, permitting, competitive bidding and contracting by the City Council in its <br /> discretion; and <br /> WHEREAS, the Project is further subject to the extent such donated funds are <br /> sufficient to complete such Project, or as the Project may otherwise be <br /> additionally funded in the future by the City Council in its discretion; and <br /> WHEREAS, in the meantime, while the City undertakes Project design and <br /> feasibility in compliance with applicable laws as well as City plans and Project <br /> timing, which is yet to be determined by the City Council, a fund will be created <br /> for the purposes established herein at the FM Area Foundation, and the City will <br /> request these funds in the future as needed to cover expenses for the Project to <br /> the extent they are designed, approved, funds are determined sufficient, and <br /> contracts are awarded by the City Council for the construction of the Project in <br /> the future. <br />
