bond for new Faciliries installarion, relocarion, replacement, or repairs,when the Company's <br /> � complerion of its work is required in order for the City to proceed with its work for constructing a <br /> public improvement project to the Public Way. <br /> 3.5 Avoid Damage to Gas Facilities. Nothing in this Ordinance relieves any person, <br /> including the Company, from liability arising out of the failure to exexcise reasonable care to avoid <br /> damaging Gas Faciliries or other persons or property while performing any acrivity. <br /> 3.6 Notice of Im�rovements. The City will give the Company reasonable norice of plans for <br /> improvements to Public Grounds or Public Ways where the City has reason to believe that Gas Facilities <br /> may affect or be affected by the improvement. The notice must contain: (i) the nature and character of <br /> the improvements, (u) the Public Grounds and Public Ways upon which the improvements are to be <br /> made, (ui) the extent of the imptovements, (iv) the time when the City will start the work,and(v)if more <br /> than one Public Ground or Public Way is involved,the order in which the woxk is to proceed. The norice <br /> must be given to the Company a sufficient length of time in advance of the actual commencement of the <br /> work to permit the Company to make any necessary additions, alterarions or repairs to its Gas Faciliries <br /> the Company deems necessary. <br /> 3J. Ma�ing Information. Upon request, the Company must promptly provide mapping <br /> informarion for any of it underground Gas Faciliries in accordance with Muinesota Rules parts 7819.4000 <br /> and 7819.4100,as the same may be amended from time to time. <br /> SECTION 4. RELOCATIONS. <br /> �-' 4.1 Relocarion of Gas Facilities in Public Wavs. T'he Company shall comply�with Minnesota <br /> Rules,part 7819.3100 and applicable law,and any applicable City ordinances consistent with law regarding <br /> relocation of Gas Facilities in Public Ways. <br /> 4.2 Relocation of Gas Facilities in Public Ground. The City may require the Company at the <br /> Company's e�ense to relocate or remove its Gas Faciliries from Public Ground upon a finding by the <br /> City that the Gas Faciliries have become or will become a substantial impairrnent to the e�sting or <br /> proposed public use of the Public Ground. Such relocation shall comply with applicable ordinances <br /> consistent with law. <br /> 4.3 Projects with Federal Fundin�. The City shall not order the Company to remove or <br /> relocate its Gas Faciliries when a Public Way is vacated,improved or realigned for a right-of-way <br /> project or any other project which is financially subsidized in whole or in part by the Federal <br /> Government or any agency thereof,unless the reasonable non-betterment costs of such relocation <br /> are first paid to the Company;provided however, that the City is obligated to pay the Company only <br /> for those portions of its relocarion costs for which the City has actually received federal funding <br /> specifically allocated for the relocation costs in the amount requested by the Company for such <br /> relocarion costs,which allocated funding as requested by the Company in writing to the City, the <br /> City shall thereafter specifically request from the applicable federal government entit��. Relocarion, <br /> removal or rearrangement of any Company Gas Facilities made necessary because of the extension <br /> into ox through the City of a federally-aided highway pxoject shall be governed by the provisions of <br /> Minnesota Statutes, Secrion 161.46, as supplemented or amended. It is understood that the rights <br /> � herein granted to the Company are valuable rights. <br /> 4 <br />
