14. There are no outstanding items that remain to be worked out between the <br /> �-- applicant and the City Attorney. <br /> 15. The Final Plat has been prepared in agreement with the preliminary plat. <br /> 16. Updated title work has been provided and approved by the City Attorney. <br /> 17.No financial security is required because all improvements are being constructed <br /> and maintained privately and not by the City. <br /> 18. An independent survey review has been completed by Terry J. Betley, LS, license <br /> No. 15811. He has found the plat to agree substantially with Minnesota Statutes <br /> 505.02 and the MSPS Plat Manual. <br /> All members voted"aye". Motion carried. <br /> APPLICANT: City of Pequot Lakes. <br /> Applicant requests an Ordinance Amendment, Shoreland Conservation Design. <br /> Mr. Marohn explained the Staff Report. <br /> Tim Moore, Pequot Lakes property owner, has reviewed the Staff Report on the website <br /> and pointed out that Section 1, General A, refers to density higher than normal, yet no <br /> density increases are allowed. Mr. Marohn stated that statement could be removed. Mr. <br /> Moore verified that no density increases would be allowed. Mr.Marohn agreed. <br /> �. Section 3 D, Common Open Space, was discussed. The minimum width of an access <br /> corridor is 50 feet. Mr.Marohn stated that Section D talks about preservation of common <br /> open space. It would be an undeveloped 50-foot area; a natural looking open space. <br /> Mr. Marohn stated that this language does come from the DNR Alternate Standards. Mr. <br /> Marohn then read from the DNR Alternate Standards and it is the same as our proposed <br /> language. <br /> Mr. Moore pointed out that Suitable Area is not defined. Buildable Area and Suitable <br /> Area are not synonymous. <br /> A motion was made by Tom Adams, seconded by Mark Hallan,to table this hearing. All <br /> members voted"aye".
