The Commission is forwarding you one recommendation for your consideration. <br /> i. Final Plat of Wilderness Resort Garages, Wilderness Resort Villas LLC. <br /> Wilderness Resort Villas was approved for a Conditional Use Permit and Preliminary Plat by <br /> the City Council in May of 2008. The Final Plat was approved in September of 2008. Since <br /> that approval, the property owner requested that the City allow them to split the final plat <br /> into two documents — the first being the final plat for the resort dwelling units or accessory <br /> lodge facilities and the second for the accessory garage structures that were part of the <br /> amended preliminary plat. <br /> Following the Planning Commission's guidance that this would be acceptable, the applicant <br /> filed the first final plat and has now submitted a second final plat—this one of the garages — <br /> for approval. <br /> The Planning Commission recommends that the final plat be approved. The <br /> recommendation is based on the following findings of fact: <br /> i. The City Engineer has reviewed the erosion control plan. The erosion control plan is <br /> regulated through a State General Permit and there are no City requirements that <br /> would usurp these State requirements.The Engineer has not stated any concerns. <br /> 2. The City Engineer has reviewed the stormwater management plan. The stormwater <br /> management facilities are not going to be constructed or maintained by the City. The <br /> Engineer stated the stormwater management plan does direct runoff from their <br /> property into infiltration basins greatly minimizing, if not eliminating in many cases, <br /> any runoff that may leave their property or get directly into the lake and it is to his <br /> satisfaction. <br /> 3. The City Attorney has reviewed the rental contract and association contracts. Mr. <br /> Sandelin has stated the documents establishing the shared villas, garage association, <br /> and the amended declaration to the initial Wilderness Resort Villas declaration meet <br /> the requirements of Minnesota law and the City code. <br /> 4. The applicant has submitted vacation drawings and legal descriptions of the area of <br /> High Pine Street and City parcel to be vacated by the City to clear up the concern Mr. <br /> Sandelin had regarding the transfer of property to the City for a road as part of a lot <br /> split for property that was owned by the resort in exchange for the resort identifying <br /> an easement for access to the resort which will serve as an easement for adjoining <br /> properties. <br /> 14084 Baxter Drive, Suite 7 1 Baxter, Minnesota 56425 1 866.900.3064 1 www.communitygrowth.com <br />
