City of Pequot Lakes, Independent School District 186 <br /> and City of Breezy Point, County of Crow Wing <br /> State of Minnesota <br /> Emergency Siren Maintenance Joint Maintenance Agreement <br /> This Agreement is made between the City of Pequot Lakes ("Pequot <br /> Lakes"), Independent School District 186 ("the School District") and the City of <br /> Breezy Point ("Breezy Point"), <br /> WHEREAS, Pequot Lakes, the School District and Breezy Point desire to <br /> purchase, install and maintain a public safety siren for the benefit of residents, <br /> guests, students and employees from each of the three areas covered by this <br /> agreement; and <br /> WHEREAS, Pequot Lakes, the School District and Breezy Point agree to <br /> be equally responsible for the maintenance of the public safety siren to be <br /> installed on the site of the Eagle View Elementary School in 2009 on the terms <br /> and conditions set forth herein; <br /> `-- NOW THEREFORE, it is agreed as follows: <br /> 1. EFFECTIVE DATE: This Agreement is made this 1St day of January <br /> 2009, and is effective upon adoption and execution by Pequot Lakes, the <br /> School District and Breezy Point. <br /> 11. PURPOSE: The purpose of this Agreement is to provide the basis for and <br /> outline the terms and conditions upon which Pequot Lakes, the School <br /> District and Breezy Point will work together jointly to operate and maintain <br /> the public safety siren and hereby engage each entity to provide such <br /> service in accordance with and subject to the terms of this agreement. <br /> III. SCOPE AND DESCRIPTION OF AGREEMENT: As per this agreement, <br /> Pequot Lakes, the School District and Breezy Point shall equally share all <br /> maintenance costs, with each party paying one-third of any costs incurred <br /> to install, operate and maintain the siren referred to in the opening <br /> statement of this agreement. <br /> IV. TERM OF AGREEMENT: This Agreement shall be effective perpetually <br /> for the full life of the siren, until such time as the siren may be permanently <br /> removed by mutual agreement of all three parties. <br /> Page 1 of 2 <br />
