c;r�ef <br /> Pequot <br /> Lakes� <br /> NEW BUSINESS—ORDINANCE AMENDMENT,FLAGPOLE HEIGHT DISCUSSION <br /> Agenda Item: 6 (b) <br /> Background Information: At their May �, 2oi9 meeting, the City Council <br /> directed the Planning Commission to review the maximum height for flagpoles. <br /> This request was the result of the denial for a Variance for an 8o-foot flagpole in <br /> the Commercial zone. The Minutes of that meeting are included as Agenda Item <br /> 8 (a). <br /> Fla ole Hei ts: <br /> City of Princeton 6o feet; Flagpoles located in a Business or Industrial <br /> District <br /> City of Baxter 5o feet or io feet above the actual building height, <br /> whichever is less. <br /> Ci of Nisswa 25 feet; structure hei ht <br /> Ci of Pe uot Lakes 25 feet; structure hei ht in the Commercial Zone <br /> In addition to flagpole height, discussion included lighting of the American Flag <br /> at night. <br /> "It is the uniuersal custom to display the flag only from sunrise to sunset on <br /> buildings and on stationary flagstaffs in the open. However, when a patriotic <br /> effect is desired, the flag may be displayed 24 hours a day if properly <br /> illuminated during the hours of darkness." (CRS Report for Congress 2008) <br /> "The Flag Code states it is the universal custom to display the flag only from <br /> sunrise to sunset on buildings and on stationary flag staffs in the open. <br /> HoweUer, when a patriotic effect is desired, the flag may be displayed 24 hours <br /> a day if properly illuminated during the hours of darkness. The American <br /> Legion interprets "proper illumination" as a light specifically placed to <br /> illuminate the flag (preferred) or having a light source sufficient to illuminate <br /> the flag so it is recognizable as such by the casual observer." (American Legion <br /> website) <br /> Downward directional lighting is required in the Commercial, Light Industrial, <br /> Recreation, and Public zones. There are no lighting standards in the Forest <br /> Management, Agriculture, Rural Residential, Transition Residential, Shoreline <br /> Residential, or Shoreline Commercial.
