CITY OF PEQUOT LAKES <br /> PLANNING COMMISSION RESOLUTION�9-_ <br /> A RESOLUTION APPROVING THE REQUEST FOR A CONDITIONAL USE <br /> PERMIT TO CRF�ATE A�5 UNIT PLANNED U11TIT DEVELOPMENT <br /> WHEREAS,the applicant, Resort Development LLC/Premier Homes, seeks a <br /> Conditional Use Permit under City Code Section i�-11.6 to create a i5 unit Planned Unit <br /> Development along Little Walnut Lane,legally described on the attached Exhibit A(the <br /> "Property"),which is zoned Rural Residential; and, <br /> WHERF.AS,the Planning Commission conducted a public hearing on April i8, 2oi9, <br /> and received public testimony regarding the proposed Conditional Use Permit; and <br /> WHEREA.S, all required notices regarding the public hearing were properly made; and <br /> WHERF�AS,the Planning Commission,having reviewed and considered the <br /> application, staff analysis and public testimony regarding the proposed Conditional Use <br /> Permit at its meeting of April i8, 2oig, does hereby resolve the Conditional Use Permit <br /> application as set forth below. <br /> NOW,THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION <br /> OF THE CITY OF PEQUOT LAKES,MINNESOTA,that it adopts the following <br /> findings of fact related to the requested Conditional Use Permit. <br /> A. Mandatory Criteria: <br /> i. Criteria #i: The use or development is an appropriate conditional use in the <br /> land use zone. <br /> Finding #A�: The proposed Planned Unit Development is an appropriate use in <br /> the"Rural Residential"zone. Residential Planned Unit Developments are <br /> allowed in the"Rural Residential"zone with a Conditional Use Permit. <br /> 2. Criteria #2: The use or development,with conditions, conforms to the <br /> comprehensive land use plan. <br /> Finding #A2: The proposed development pattern is in harmony with the land use <br /> density,transportation facilities, and community facilities objectives in the <br /> Comprehensive Plan. The Plan identifies the subject property as"Rural <br /> Residential"which is, "Development patterns in this area are low-density <br /> residential. These areas will not be served by municipal utilities and the amount <br /> of new roads and development will be limited." <br /> 1 <br />
