12. "Member"shall mean all persons who are Members of the Association by virtue of <br /> being Owners as defined in this Declaration. The words"Owner"and "Member" may be <br /> used interchangeably in the Governing Documents. <br /> 13. "Occup�nt"shall mean any person or persons,other than an Owner, in possession of or <br /> residing in a Unit. <br /> 14. `•Owner„shall mean a person who owns a Unit, but excluding Contract for Deed <br /> vendors, Mortgagees and other secured parties within the meaning of Section 515B. <br /> 1-103(29)of the Act. The term "Owner"includes,without limitation,Contract for Deed <br /> vendees and holders of life estates. <br /> 15. "P�Wall"shall mean the shared wall between two Dwellings. There is no intention <br /> for any of the Units to have a Party Wall. <br /> 16. "Person„shall mean a natural individual,corporation, limited liability company, <br /> partnership,trustee,or other legal entity capable of holding title to real property or <br /> having legal identity before a Minnesota Court of Law. <br /> 17. "Plat„shall mean the recorded plan depicting the Property pursuant to the <br /> requirements of Section 5156.2-110 of the Act,and satisfying the requirements of <br /> Minnesota Statutes Chapter 505, including any amended Plat recorded from time to <br /> time in accordance with the Act. <br /> 18. " 'shall mean all of the real property submitted to this Declaration,including <br /> the Dwellings and all other structures and improvements located thereon now or in the <br /> future. The Property as of the date of this Declaration is legally described in Exhibit A <br /> attached hereto. <br /> 19. "Rental Manaeement Agreement"shall mean an agreement between an Owner and the <br /> Management Agent providing for the rental, maintenance, repair,upkeep and , <br /> housekeeping of a Unit during any period said Unit is designated for use under a Rental <br /> Agreement by other persons for recreation or other permitted uses. <br /> 20. "Residential Use"or"Residential Purpose"shall mean use as a dwelling,whether <br /> primary,secondary,seasonal,or otherwise occupied by individuals pursuant to a rental <br /> agreement,and also transient use such as temporary resort lodging. <br /> 3 <br />
