AGENDA ITEM #10.1 <br /> City Of " <br /> Pequot <br /> Lakes= _ <br /> REPORT TO CITY COUNCIL <br /> Report Prepared by: Nancy Malecha <br /> Date: Apri12, 2019 <br /> Subiect: Jerry Akerson's Absence <br /> Report: For the past several months, Jerry Akerson has been absent at City <br /> Council meetings due to personal reasons. I spoke with Jerry on March 26�' and he <br /> hopes to be back beginning with the June 2019 City Council meeting. The Council <br /> has the following options for consideration per Minnesota Statute 412.02 Subd. 2b. <br /> A vacancy in the office of mayoY o�council membe�may be decla�ed by the <br /> council when the officeholde� is unable to se�ve in the o�ce o�attend <br /> council meetings foY a 90-day pe�iod because of illness, o�because of <br /> absence fYom ov��efusal to attend council meetings fo�a 90-day peYiod. If <br /> any of the p�eceding conditions occu�s, the council may, afteY it has by <br /> �esolution declared a vacancy to exist,fill the vacancy at a �egula� oY <br /> special council meeting fo� the �emainde�of the unexpi�ed teYm, o� until the <br /> peYson is again able to �esume duties and attend council meetings, <br /> whicheve� is ea�lie�. When the peYson is again able to �esume duties and <br /> attend council meetings, the council shall by resolution �emove the <br /> tempo�aYy officeholdeY and YestoYe the oYiginal officeholde�. <br /> Therefore, the Council has the following options. <br /> • Do nothing and wait for Jerry Akerson's return, which is anticipated in June. <br /> • Because of Jerry Akerson's ongoing illness and resulting absence, declare a <br /> vacancy and appoint a temporary officeholder until Jerry is able to resume <br /> duties and attend council meetings. The appointment process could entail a <br /> public notice to citizens informing them of this vacancy and request resumes <br /> or letters of interest, or such other process as the Council determines. See <br /> atta.ched resolution. <br />
