COUNCIL <br />MEMBER MALECHA WITHDREW THE SECOND. <br />COUNCIL MEMBER SJOBLAD MOVED TO DENY THE APPEAL AND <br />APPROVE THE CONDITIONAL USE PERMIT FOR THE DOG <br />BOARDING DAYCARE FACILITY FOR JEFF GARLAND, L&J <br />INVESTMENTS SUBJECT TO FINDINGS OF FACT LISTED AS <br />NUMBERS 1 -18 AND THE TEN CONDITIONS FROM THE JULY 15, <br />2010, PLANNING COMMISSION MEETING PLUS AN ADDITIONAL <br />ELEVENTH CONDITION REGARDING AN UNANNOUNCED ON -SITE <br />INSPECTION TO TAKE PLACE ONE TIME PER MONTH FOR THE <br />FIRST YEAR, ONCE A QUARTER FOR THE SECOND YEAR, AND <br />EVERY SIX MONTHS FOR THE THIRD YEAR. COUNCIL MEMBER <br />MALECHA SECONDED THE MOTION. MOTION CARRIED 5 -0. <br />IN., 6.2. Preliminary Plat of Wilderness Resort Villas <br />Chuck Marohn explained that the Planning Commission held a public <br />hearing to increase the overall density of the preliminary plat of <br />Wilderness Resort Villas from 45 units to 60 units. He noted that the <br />Planning Commission is recommending approval based on 17 findings of <br />fact. <br />Council Member Sjoblad asked if the lake associations are in agreement <br />with approving the conditional use permit and preliminary plat. Chuck <br />Marohn stated that the lake associations wrote a letter regarding the issue <br />and were in agreement with most conditions, but not all of the conditions. <br />Council Member Sjoblad stated that he is not pleased with the number of <br />trees that have been cut down and the fact that City is being asked to <br />make changes to the conditional use and preliminary plat which adds <br />density to the lake due to bad business decisions. <br />COUNCIL MEMBER RYAN MOVED TO APPROVE THE PRELIMINARY <br />PLAT OF WILDERNESS RESORT VILLAS SUBJECT TO 17 FINDINGS <br />OF FACT AND THE 18 CONDITIONS OF THE CONDITIONAL USE <br />PERMIT AS RECOMMENDED BY THE PLANNING COMMISSION. <br />COUNCIL MEMBER NAGEL SECONDED THE MOTION. MOTION <br />`- CARRIED 4 -1. COUNCIL MEMBER SJOBLAD OPPOSED. <br />
