City Council Minutes <br />September 7, 2010 <br />Page 2 of 13 <br />COUNCIL MEMBER MALECHA SECONDED THE MOTION. MOTION <br />CARRIED 5 -0. <br />4. Open Forum <br />There was no one present for open forum. <br />5. Presentations <br />5.1. Presentation of Minnesota Wastewater Operator's Association Award <br />Council Member Ryan informed those present that Tina Nolden was <br />awarded the Minnesota Wastewater Operator of the Year Award by the <br />Minnesota Wastewater Operator's Association. The Council congratulated <br />Tina. <br />6. Planning and Zoning Report <br />Report received by Council. <br />`' 6.1. Appeal to Dog Boarding CUP <br />Chuck Marohn explained that the City Council has received a request for <br />an appeal of the Planning Commission's decision to approve a conditional <br />use permit for Jeff Garland, L &J Investments, to operate a dog <br />boarding /daycare facility. Mr. Marohn reviewed the request to turn an <br />existing building, which is located in a rural residential zone, into a dog <br />daycare facility in a rural residential zone. He noted that the Planning <br />Commission held a public hearing on this request and discussed in length <br />the issues of traffic, chaperoning of dogs while they are outside, <br />screening, and noise. He stated that this use is allowed in the City <br />Ordinance and the City has the ability to place conditions on the approval. <br />Chuck Marohn referred to the Planning Commission Staff Report and <br />Planning Commission minutes that were included in the Council packet. <br />He indicated that the Planning Commission approved the conditional use <br />permit with ten conditions. Mr. Marohn reviewed the conditions of the <br />conditional use permit. <br />Mayor Adams noted that the Council has received all of the information <br />from the past Planning Commission meeting including the minutes of the <br />meeting, the information from the residents of Breezy Pines regarding the <br />appeal, and information from the City Attorney. <br />
