83. Dwelling, Guest Quarters. A structure, not for sale or lease, used as a dwelling unit that may contain sleeping <br />spaces and kitchen and bathroom facilities in addition to those provided in the primary dwelling on the lot. Any <br />accessory structure with kitchen or bathroom facilities shall be considered a dwelling, guest quarters. <br />182. Principal Structure or Use. The single primary structure or use on a lot, as distinguished from accessory uses <br />or structures. To be considered a principal structure, the structure must be at least 400 square feet in area and <br />must be utilized for the purpose of the principal use of the property <br />11— CLOSING <br />If this application was consistent with the City's Comprehensive Plan and the Code, then why did the City submit <br />an Ordinance Amendment at the July P &Z meeting to Exclude Kennels in RR? And specifically, it was Item B on the <br />agenda after the Reconsideration? <br />- Intent of the Code supports our appeal position <br />- The Code in its full context supports the original rejection, although the findings of fact were not specific. <br />- The pre- existing conditions on Breezy Pines Subdivision prevents the land use and is the responsibility of the City <br />to enforce these conditions as they are more restrictive. <br />- The City's action to amend the ordinance to Exclude kennels in RR supports the appeal. <br />Was the "Reconsideration" and Appeal by the applicant or a reconsideration by P &Z? <br />Time spent on a field trip in cross lake reviewing construction details on a commercially zoned dog kennel is <br />irrelevant. <br />4- <br />
