Sleutter
Sandy, Minnesota Statute 429.052 provides that the city can construct: street or road improvements outside the city limits
with the consent of the township (or county if it is unorganized territory). We don't have any ability to assess individual
property owners. If the city does this it may want to consider and agreement with the township for a financial contribution.
If this is a section of road to be maintained by the city then we should have an agreement with the township on
maintenance as well or a joint powers agreement if the maintenance obligations are to be shared. If the property is
ultimately annexed into the city then we have a right to assess.
Let me know if you have any other questions. Thanks.
Paul Sandelin
SANDELIN LAW OFFICE
30849 First Street P.O.
