ORDINANCE NUMBER�8-�2 SECOND SERIES <br /> AN ORDINANCE AMENDING CHAP'rER��OF THE CITY CODE <br /> �y REGARDING ENFORCEMENT <br /> CITY OF PEQUOT LAKES <br /> COLTNTY OF CROW WING <br /> STATE OF MINNESOTA <br /> The City Council of the City of Pequot Lakes does ordain as follows: <br /> Purpose and Intent: The purpose and intent of this ordinance is to amend Chapter <br /> ��of the Pequot Lakes City Code regarding enforcement. <br /> Amendment: Chapter��,Article �2.�shall be amended as follows: <br /> Section ��-�2.� VIOLATIONS AND PENALTIES <br /> �. Violation of any provision of this Chapter shall be considered either an <br /> administrative offense subject to an administrative penalty in the amount of$ioo.00 per <br /> day; a criminal offense; or a civil offense subject to enforcement through civil remedies. <br /> Each act of violation in every calendar day upon which said violation occurs or continues <br /> may be considered a separate offense. <br /> 3. In all cases where the City incurs fees and costs in reviewing, investigating, or <br /> administering a land use application for purposes of enforcing compliance with this <br /> � Chapter, the offending party, real estate owner, and/or permit holder shall be required <br /> `� joindy and severally to reimburse the City for the City's fees and costs associated with <br /> enforcing compliance with this Chapter. Fees and costs include, but are not limited to, <br /> attorney's fees, engineering fees,consultant fees, and other professional services deemed <br /> necessary by the City. The City also reserves the right to record a lien against real estate <br /> that is the subject of a land use enforcement action pursuant to Section 5i4.6� of <br /> Minnesota Statutes,for any of the aforementioned unpaid fees and services. <br /> Effective Date: This ordinance amendment shall be in full force and effect from and <br /> after passage and publication according to state law. <br /> Repeal: This ordinance shall repeal all ordinances inconsistent herewith. <br /> Passed by the Pequot Lakes City Council this 4�day of September, 20�8. <br /> Nancy Adams <br /> Mayor <br /> ATTEST: <br /> �- Nancy M echa <br /> City Administrator <br /> 1 <br />
