CITY OF PEQUOT LAKES <br /> �" RESOLUTION 18-11 <br /> RESOLUTION DECLARING ABANDONED PROPERTY AND PROVIDING <br /> FOR ITS DISPOSITION <br /> WHEREAS, on June 6, 2017, the Pequot Lakes City Council adopted Resolution 17-18, <br /> declaring that garbage,junk, lumber, scattered fencing materials, a dilapidated structure <br /> near the fire pit, inoperable motor vehicles, a fifth-wheel trailer with a makeshift wall, <br /> metal pieces and other debris that had been allowed to accumulate and were present in <br /> plain view on the premises of the real property located at 3952 County Road 17 in <br /> Pequot Lakes ("subject propert�') to be code violations and a public nuisance; <br /> WHEREAS, following the property owner's failure to take the required corrective actions <br /> to remedy the code violations and nuisance conditions present on the subject property, <br /> the City obtained an administrative search warrant from the Crow Wing County District <br /> Court dated September 20, 2017, authorizing the City's agents to enter onto the subject <br /> property and seize any property reasonably believed to be evidence of a violation of the <br /> City Code and retain and dispose of such property as approved by law; <br /> WHEREAS, the City's agents executed the administrative search warrant on the subject <br /> property on September 27, 2017, and removed numerous items of personal property <br /> `- from the subject property because such items were stored thereon in violation of the <br /> City Code; <br /> WHEREAS, on October 24, 2017, the City provided notice to the owner of the subject <br /> property of all items removed therefrom and retained by the City, and advising the <br /> owner of the subject property of the owner's right to reclaim all such items of personal <br /> property within 60 days, pursuant to City Code, Section 3-8.2(5) (See true and correct <br /> copy of notice attached as Exhibit A hereto); <br /> WHEREAS, the owner of the subject property reclaimed all items of personal property <br /> retained by the City and took possession thereof, with the exception of a Fifth-wheel <br /> camper as shown in the photographs attached hereto as Exhibit B, which camper was <br /> not reclaimed within the applicable 60-day timeframe under City Code Section 3-8.2(5); <br /> WHEREAS, pursuant to City Code Section 3-8.2(5)the City Council may now declare <br /> such property to be abandoned and order the disposal of the same according to <br /> procedures outlined therein. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PEQUOT <br /> LAKES, MINNESOTA that based on facts and circumstances above-described, does <br /> hereby resolve that: <br /> � <br />
