for more than one year after expixa.tion of the tertn set forth in Section 2.1, unless an extension is
<br /> othexwise agYeed in wriring by the City and the Company in which case the franchise may be extended
<br /> up to an additional six months.
<br /> SECTION 3. LOCATION�OTHER REGULATIONS.
<br /> 3.1 Location of Facilities. Gas Facilities shall be loca.ted, constructed.and ma.inta.ined so as
<br /> not to interfere with the safety and convenience of ordinary travel along and over Public Ways and so as
<br /> not to disrupt nort��a1 operation of any City Utility System. Ga.s Facilities shall be located on Public
<br /> Grounds as determined by the City. The Company's construction, reconstruction, operation, repair,
<br /> maintena.nce,location and relocation of Gas Facilities shall be subject to permits if required by separate
<br /> ordinance or la,w and to other reasonable regulations of the City imposed pursuant to ordinance,rule or
<br /> statute to the e�ctent not inconsistent with the specific terms of this franchise agreement Company ma.y
<br /> abandon underground gas fa.cilities in place, provided, at Cit�s reguest, Company, at Companq's own
<br /> expense,will remove abandoned gas fa,cilities interfering with a Cixy improvement project,but only to the
<br /> extent such gas facilities are uncovered by excavation as pa.tt of the City's impxovement project
<br /> 3.2 Field Locations. The Company shall provide fielc�'locations for its underground Gas
<br /> Facilities within the City consistent with the Yequirements o£Minnesota Statutes,Chapter 216D.
<br /> 3.3 Street O�enines. The Company shall not open oY disturb any Public Ground or Public
<br /> Way foY any purpose without first haoing obtained a permit from the Citp, if required by a separa,te
<br /> ordina.nce,for which the City ma,y impose a xeasona,ble fee. Pe.xmit cond�tions imposed on the Company
<br /> shall not be more butdensome tha.n those impased on other utilities for similar facilities or work. The
<br /> Company ma.p, howeveY, open and disturb the surfa�e of any Public Gxound or Public Way without
<br /> permission from the City where an emergency exists requiring the immedia,te repair of Gas Facilities. In
<br /> such emergency event, the Comp�.tiy shall norify the City by telephone, ema.il or similar notice to the
<br /> office designated by the City as soon as practicable,but before commencement of the emergency repair,
<br /> if reasona.bly possible. Not later thart`the.second wor�ing day therea.fter, the Companp shall applp for
<br /> any required per�nits and pap anp requifed fees. --
<br /> 3.4 Restorat'ton. After undertaking any work requiriug the opening of any Public Ground
<br /> or Public Way,Company s�all restore the sxt�ne in accorda.nce with Minnesota Ru1es,part 7819.1100
<br /> and applicable City ordinances consistent with la,w. The Company shall restore the same,including but
<br /> not limited to paving and its founda,tion,to as good a condition as formerly existed,and shall ma.intain
<br /> any paved surface in good condition for one yeat thereafter and unpaved sutfaces for one yeat
<br /> theYeafter. The work shall be completed as promptly as weather permits,and if Compa.ny shall not
<br /> promptly perform and complete the work,remove all dirt,rubbish,equipment and material,and put the
<br /> Public Ground oY Public Way in the said condition,the City shall ha,ve,aftex dema.nd to the Company
<br /> to cure and the passage of a reasonable period of time following the demaud,but not to exceed five
<br /> days,the right to ma.ke the restoration at the expense of the Company. The Company shall pay to the
<br /> City the cost of such work done for or performed by the City or its agent This remedp sha.11 be in
<br /> addition to any other remedy available to the City for noncompliance with this Section 3.4„but the City
<br /> hereby waives, except as otherwise required by law,anp requirement for Company to post a
<br /> construction performance bond, certificate of insutance,letter of credit or any other form of
<br /> security or assutance that ma,y be required,under a separate existing or future ordinance of the Citp,
<br /> of a person or entity obtaining the City's permission to install,replace ot ma.intain facilities in a
<br /> Public Way. Notwithstanding the foregoing,the City xeserves the right to requ.ire a performance
