8. Any changes to the Association documents shall be submitted to the City for <br />approval and must be acceptable to the City. <br />9. The applicant shall apply for a revised stormwater NPDES permit. The City <br />will be copied with this application. <br />io. The applicant shall be allowed 40 moorings. No more than 20 moorings <br />shall be eligible for a shore station or other type of covering or canopy. <br />ii. The placement of the docks shall be done at the direction and <br />recommendation of the Department of Natural Resources. <br />12. The road in the bluff and shoreline setback shall be removed and re- <br />vegetated. An 8 -foot wide walking trail may replace the road; however, all <br />automobile traffic shall be banned. The walking trail shall be constructed <br />with pervious materials. <br />13. All buildings scheduled for removal shall be removed within 36 months of <br />this approval. There shall never be more than 30 units in the first tier. <br />14. The applicant shall be responsible for all expenses that the City incurs in <br />administering these provisions. The applicant will be billed for the charges of <br />the City Attorney, City Engineer, City Planner and any other staff member or <br />special consultant whose expertise is needed to administer these provisions. <br />Invoices shall be paid within 3o days of receipt. Charges may be disputed by <br />appealing in writing to the City Council within 20 days of receipt. <br />15. Boat canopies shall be of dark earth tone colors, such as dark green. <br />16. Storage units shall be of earth tone colors. <br />17. The requested second beach is not allowed as part of this approval. <br />18. The applicant shall apply for pool inspection by the Department of Health as <br />per State Statutes. The City shall be copied with the application. The pool <br />must not be placed into public use until the Health Commissioner's <br />inspection shows compliance with Minnesota Rules, parts 4717.0150 to <br />4717.3975• <br />19. No additional building permits will be issued after 20 until the amenities <br />building is constructed and operational and, in addition, no additional <br />building permits will be issued after 40 units are built until the lodge is <br />constructed and operational. <br />I will be at the upcoming meeting to assist the City Council in the appeal of the Planning <br />Commission's decision regarding the Garland CUP for a dog kennel.
