Section 17 -13.5 NOTICES <br />The failure to give mailed notice to individual property owners, or defects in the notice shall not invalidate the <br />proceedings, provided a bonafide attempt to comply with this Chapter has been made. <br />Comment. A bonafide attempt was not made to notify the property owners, or in this case the subdivision <br />owners. Prior, proper notification to the subdivision would have brought the facts presented in <br />this appeal during or prior to the initial CUP hearing. In addition, the property was purchased <br />in the early Spring of 2010 by the applicant which provided for reasonable notification to occur <br />in lieu of 3 property owners.
