1. Maintains or permits a condition which unreasonably annoys, injures, or endangers the safety, health, morals,
<br />comfort, or repose of any considerable number of members of the public;
<br />Section 7 -2.4. PUBLIC NUISANCES AFFECTING PEACE AND SAFETY
<br />3. All unnecessary noises and annoying vibrations.
<br />15. Noisy assembly, which shall mean a gathering of more than one person in a residentially zoned or used area of
<br />building between the hours of 10:00 p.m. and 6:00 a.m. that would be likely to cause significant discomfort or
<br />annoyance to a reasonable person or normal sensitivities present in the area considering the time of the day and
<br />the residential character of the area.
<br />16. Knowingly permitting real estate under one's care or control to be used for a noisy assembly, as previously
<br />described.
<br />Comment: We understand that #15 and 16 above are designed for party control, loud music, etc. and is
<br />not the intended use to enforce dog barking, but only include this to demonstrate precedence
<br />established to preserve normal sensitivities and character of the area and the inconsistency of
<br />allowing 25 -30 dogs to gather and hope that the insulation is sufficient or rather that the dogs
<br />may not bark as implied by the applicant.
<br />Section 7 -2.5. DUTIES OF CITY OFFICERS
<br />The police department shall enforce the provisions of this Chapter relating to nuisances affecting public safety and
<br />other nuisances. Such officers shall have the power to inspect private premises and take all reasonable precautions
<br />to prevent the commission and maintenance of public nuisances.
<br />Section 7 -2.8. PENALTY
<br />Any person convicted of violating any provisions of this Chapter is guilty of a misdemeanor.
<br />CHAPTER 9 — LICENSE AND BUSINESS REGULATIONS
<br />ARTICLE 2. LICENSING AND REGULATING THE KEEPING OF DOGS
<br />Section 9 -2.1. DEFINITIONS
<br />1. Owner. Any person, firm, corporation, organization, or department owning, keeping, harboring or acting as
<br />custodian of a dog or dogs.
<br />2. At Large. The dog is off the property of the person, firm, corporation, organization, or department owning,
<br />keeping, or harboring said animal, and the dog is not under restraint.
<br />3. Pog. All dogs over six (6) months of age.
<br />4 Under Restraint. The dog is on the premises of the person, firm, corporation, organization, or department
<br />owning, keeping, or harboring the animal, if it is at heel beside a person having custody of it, if it is obedient to that
<br />person's command, if it is within a private motor vehicle of a person, owning, keeping or harboring the animal, or if
<br />it is controlled by a leash not exceeding six (6) feet in length.
<br />Section 9 -2.11. VARIOUS OFFENSES
<br />1. No person shall keep or harbor a dog which habitually barks, yelps, howls, cries or whimpers so as to
<br />unreasonable disturb the peace and quiet of any person in the vicinity. The phrase unreasonably disturb the
<br />peace and quiet" shall include but is not limited to, the creation of any noise by a dog which can be heard by any
<br />person, including a law enforcement officer, from a location at least 75 feet from the building or premises where
<br />the dog is being kept, and such noise occurs over at least a five (5) minute period of time, with one (1) minute or
<br />less lapses of time between each dog noise during the said five (5) minute period.
<br />2. It shall be considered a nuisance for any dog to frequent school grounds, parks; to chase vehicles; to worry,
<br />chase, or molest any persons, if such person is not on the property of the owner of the dog; to worry, chase, or
<br />molest any persons traveling peaceably on the public road; or to molest, defile or destroy any property public or
