AGENDA ITEM #9.3.B <br /> City Of '' <br /> Pequot <br /> Lakes= -- <br /> REPORT TO CITY COUNCIL <br /> Report Prepared by: Tim Houle <br /> Date: October 2, 2018 <br /> Subiect: Maintenance Facility Project— Boser Construction Payment <br /> Certificate #6 <br /> Report: Attached is the Application and Payrnent Certificate #6 in the amount <br /> of$149,163.78 from Boser Construction for the Maintenance Facility Project. The <br /> City is currently retaining approximately $34,000. <br /> The substantial completion deadline for this Project is Friday, September 28th. As <br /> of the writing of this memo on September 26�', Boser Construction said they will <br /> be close but will not be completely finished with the Project by the substantial <br /> completion date. They have not given us an estimated completion date. We <br /> reminded Boser Construction of the contract time provisions, including the <br /> liquated damages (LD) clause which is $500 per day until substantial completion. <br /> As the contract states, LDs are not a penalty and are for costs incurred by the City. <br /> One of these costs will be our time working with Boser Construction to get to <br /> completion. It has been noted that even if the site was final graded, topsoiled, and <br /> seeded, the site will not have grass coverage until later next spring (snow melt and <br /> storm drainage infiltration may need to be dealt with). <br /> We will continue to work with Boser Construction as they finish this Project. We <br /> anticipate there will be more updates on contract time and completion at the <br /> November City Council meeting. <br /> Council Action Requested: Council motion approving the Application and <br /> Payment Certificate #6 from Boser Construction in the amount of$149,163.78. <br />
