However, the City has adopted the MPCA standards and would be enforcing their code.
`-- The City Code is enforced by the City.
Mr. Selvestra stated the City Code has a mechanism to remedy noise issues but stated
Coon Hounds can be heard up to 5 miles. He moved here for peace and quiet. Mr.
Marohn explained that the Planning Commission administers the Land Use Code,
Chapter 17. The Police Department enforces Chapter 9. We have a noise standard and if
the property exceeds that standard it would be violating the Code and the permit would
be revoked.
Mr. Marohn stated that he is not an attorney, but if there were an ordinance amendment
pertaining to this, the ordinance in place at the time of the application would be applied.
Any subsequent application would fall under the new code.
Bonnie Olson, adjacent property owner, 31160 Eastwood Drive — She is a realtor. She
has a copy of the plat of Breezy Pines indicating 5 acre parcels. It is quiet. The map
from Google shows not very many woods and trees at the corners. Harly's house is 45
feet away, very close. As a realtor the market values would go down; we don't want to
see our market values decrease. She looked at Northland Pet Lodge. There are
businesses on either side and within %2 t o 3/4 mile there are no residential properties
around it. There are commercial properties next door.
Harley Simchuck — the Pequot Lakes Minutes of February 17, 1998, Kennedy's request
\.1 for a CUP for a Vet Clinic. It was denied and should be in a zoned area and not in a
residential area. This has been at the Planning Commission before.
Chairman Woog stated that Planning Commission member Deb Brown was the applicant
for that CUP. She submitted a letter earlier. The location was on Government Drive and
East Sibley Street. Today's ordinance would not allow it in that location. She stated the
application was for a vet clinic, not a kennel.
Harly Simchuk — If you approve the kennel today, would you have to meet OSHA
requirements'. Mr. Marohn stated that OSHA would administer their requirements. Mr.
Simchuck stated the ASPCA is concerned about animals being alone at night. The
ASPCA is the cruelty society for animals.
Kevin Littman, 31177 Eastwood Drive — stated he lives due north of the property on Lot
3. He is concerned with loss of property values and dog barking issues. Conditions
could be set that will satisfy proper control of dog barking, but what is the mechanism? It
should be the applicant, not the neighbors. Property values would be reduced; where is
the proof that they will not be reduced? He works with decibel levels and has an
engineering degree. He can hear snowmobiles and car traffic and it is quick and gone.
What is the decibel level of dog barking? He would also like some information on item
B, the ordinance amendment to exclude dog boarding. Chairman Woog stated at the last
meeting when this application was denied, the Planning Commission directed Staff to
Minutes 4
Pequot Lakes Planning Commission
July 17, 2010
