ORDINANCE NUMBER 18- , SECOND SERIES <br /> AN ORDINANCE AMENDING CHAPTER 7, ARTICLE 1 OF THE CITY CODE <br /> REGARDING ENFORCEMENT OF ADMINISTRATIVE OFFENSES AND ISSUANCE <br /> OF PENALTIES RELATED TO THESE OFFENSES WITHIN THE <br /> CITY OF PEQUOT LAKES <br /> COUNTY OF CROW WING <br /> STATE OF MINNESOTA <br /> The City Council of the City of Pequot Lakes does ordain as follows: <br /> Purpose and Intent: The purpose of this ordinance amendment is to amend Chapter 7 of the <br /> Pequot Lakes City Code regarding the enforcement of administrative offenses and issuance of <br /> penalties related to these offenses. <br /> Amendment: Chapter 7, Article 1 shall be amended as follows: <br /> Section 7-1.1. PURPOSE <br /> Administrative offense procedures established pursuant to t�Sections 7-I .1_ 7-l .1 U are <br /> intended to provide the public and the City of Pequot Lakes with an informal, cost effective, and <br /> expeditious alternative to traditional criminal charges for violations of certain City Code and <br /> Ordinance provisions. The procedures are intended to be voluntary on the part of those who have <br /> been charged with administrative offenses. At any time prior to payment of the administrative <br /> penalty as is provided for thereafter, the individual may withdraw from participation in the <br /> procedures, in which event the City may bring criminal charges or iiiitiatc �a ci��il lebal �lctiul� in <br /> accordance with law;;likewise, the City of Pequot Lakes in its discretion may choose not to <br /> initiate a� administrative e€€e�s�eiitorce�i�etit Sccli��tis 7-I.l 7-l,l l) and may bring criminal <br /> - ---_ _- - _ <br /> charges in the first instance. In the event a party participates in the administrative e€�e�se <br /> procedures estahlishe�i it� Scc:tiui�s 7-�I ,l___7-1.I(1 but does not pay the monetary penalty which <br /> may be imposed, the City of Pequot Lakes will seek to collect the costs of the administrative <br /> offense procedures as part of a subsequent criminal sentence in the event the party is charged and <br /> is adjudicated guilty of the criminal violation. Any minor traffic offense subject to an <br /> administrative fine set forth in Section 7-1.11 shall be governed by that section. <br /> Section 7-1.2. DEFINITIONS <br /> Except as may otherwise be provided or clearly implied by context, all terms shall be given their <br /> commonly accepted definitions. For purposes of this Chapter the following words and terms <br /> when used herein shall have the following meanings unless the context clearly indicates <br /> otherwise. <br /> 1. Administrative Offense. An administrative offense is a violation of a provision of <br /> the City Code/Ordinance(s) and is subject to the administrative penalties set forth in the <br />
