ORDINANCE NO. 107_, SECOND SERIES <br />AN ORDINANCE AMENDING CHAPTER 9, ARTICLE 8, OF THE CITY CODE <br />RELATING TO REGULATIONS FOR TRANSIENT MERCHANTS, PEDDLERS, <br />AND SOLICITORS <br />CITY OF PEQUOT LAKES <br />COUNTY OF CROW WING <br />STATE OF MINNESOTA <br />The City Council of the City of Pequot Lakes does ordain as follows: <br />Purpose and Intent. The purpose and intent of this ordinance amendment is to amend <br />Chapter 9 of the Pequot Lakes City Code relating to Regulations for transient merchants, <br />peddlers, and solicitors within the City of Pequot Lakes. <br />Amendment. Chapter 9, Article 8, shall be amended as follows: <br />Section 9 -8.4. LICENSING <br />4. Procedure. Upon receipt of the completed application and payment of the <br />license fee, the City Clerk, within two (2) regular business days, shall determine if <br />the application is complete. An application is determined to be complete only if <br />all required information is provided. If the City Clerk determines that the <br />application is incomplete, the City Clerk shall inform the applicant of the required <br />�.., necessary information that is missing. If the application is complete, the City <br />Clerk shall order any investigation, including background checks, necessary to <br />verify the information provided with the application. If the City denies the <br />license, based upon Seefie^ 2, #9 or- See fi .n 5-Section 9-8.6, or Section 9 -8.8, the <br />applicant shall be notified in writing of the decision, the reason for denial, and the <br />applicant's right to appeal the denial by requesting, within twenty (20) days of <br />receiving notice of rejection, a public hearing before the City Council. The <br />decision of the City Council following the public hearing can be appealed by <br />petitioning the Minnesota Court of Appeals for a Writ of Certiorari. <br />Section 9 -8.5. LICENSE EXEMPTIONS <br />1. No license shall be required for any person to sell or attempt to sell, or to <br />take or attempt to take orders for, any product of the farm or garden occupied or <br />cultivated by themselves. , ' eu4fiveAed, or- raised en wiy <br />Effective Date. This ordinance amendment shall be in full force and effect from and <br />after passage and publication according to state law. <br />Reveal. This ordinance shall repeal all ordinances inconsistent herewith. <br />
