M <br />ri <br />commurUwy <br />(�rR® T <br />INSTITUTE <br />Toll Free 866.900.3064 1 Fax 866.924.1928 <br />March 24, 2010 <br />Mayor and City Council <br />City of Pequot Lakes <br />4638 County Road 11 <br />Pequot Lakes, MN 56472 <br />Re: Planning Commission Report <br />Dear Mayor and City Council, <br />The Planning Commission met for their regularly scheduled March meeting at which <br />they held five public hearings, a special session on the Comprehensive Plan's Economic <br />Development section and reviewed various other agenda items. They acted on two of the <br />applications, continued two until April at the request of the applicants and are <br />forwarding you one ordinance amendment and one official map for consideration at this <br />time. <br />1. Ordinance Amendment on Non - Conformities. In making an <br />interpretation on a non - conforming issue, Staff became aware of some <br />ambiguities in the Code. This amendment is proposed to resolve the ambiguities. <br />Recent changes in Statute give the landowner the right to maintain — including <br />completely replace — existing non - conforming structures. Subpart 5 of Section 17- <br />4.4 conflicts with this requirement, as well as conflicting the language in Subpart <br />1. The Planning Commission is recommending removal of Subpart 5. <br />Additionally, the Commission has found that Subpart 1(C) is also inconsistent <br />with the Statute and are subsequently recommending it also be removed. <br />2. Grow Zone Overlay Map. In 2009, the City Council adopted a Grow Zone <br />overlay district providing an alternative, streamlined approach to permitting in a <br />portion of the downtown area. The amendment referred to a map which had been <br />described but not presented in a graphic format. The map was subsequently <br />reviewed by the Planning Commission and recommended to the City Council for <br />adoption as the official boundaries of the Grow Zone Overlay District. ff% <br />WWW.COMMUNITYGROWTH.COM i WWW.STRONGTOWNS.ORG <br />
