It may need to be moved to the Background <br />information. <br />PUBLIC HEARINGS — <br />APPLICANT: John Murphy <br />Applicant requests a Variance to Construct in the Bluff and Lake Setbacks <br />Mr. Marohn explained the Staff Report. Applicant was present as well as Bob Ogdahl <br />from Architecture One. Last moth the application was tabled to allow the lake setback <br />and bluff setback to be indicated on the survey. The drawing submitted tonight indicates <br />the outbuilding is being removed. Staff cannot recommend approval but should the <br />Planning Commission decide to approve, two conditions have been suggested. The <br />Planning Commission asked if they could request the sunroom be moved further out of <br />the setback. Applicant stated there is only an egress window from the basement <br />bedroom. <br />Mr. Williams stated the Findings of Fact do not support approval and need to be <br />modified. <br />There have been significant changes to the plans; the whole house has been reconfigured. <br />There are no dimensions on the plan; the site plan should indicate dimensions before <br />Staff issues a permit. <br />Staff was asked if there is still a request for a variance from the lake setback. Mr. <br />Marohn stated that there is no variance being given for lake setback. The Planning <br />Commission asked to have a plan that indicates that or include it as a Finding or <br />Condition. Mr. Marohn stated a variance from the lake setback is not necessary now. <br />The applicants are no longer asking for a variance from the lake setback. <br />Last month the Planning Commission was provided with a topographic site plan; this <br />drawing does not include that degree of detail. Mr. Ogdahl indicated they used an <br />electronic transfer from the surveyor and deleted some information they felt was not <br />necessary. The surveyor had revised the drawing indicating the correct 75 -foot setback <br />and they used it as the base drawing. <br />When asked Mr. Ogdahl stated approximately 50% of the porch is within the bluff <br />setback, or about 70 square feet. There has been a 20% reduction within the bluff setback <br />including the shed removal. <br />A motion was made by Mark Hallan, seconded by Scott Pederson, to approve the <br />variance request for porch construction as shown up to 70 square feet, based on the <br />following Findings of Fact: <br />1.
