F. Storm water runoff from the structure shall be drained away from <br />�- the lake. There shall be no direct flow of stormwater from the <br />structure to adjacent water bodies. <br />89. Deck and Platform Additions to Non - Conforming Structures. Decks and <br />platforms must meet the structure setback standards on all new construction. <br />Decks and platforms that do not meet setback requirements from public waters <br />may be allowed without a Variance provided all the following criteria and <br />standards are met: <br />A. The structure existed prior to January 1, 1995 and has not been <br />rebuilt, reconstructed or added on more than 50% since that date. <br />B. A thorough evaluation of the property and structure reveals no <br />reasonable location for a deck or platform which meets or exceeds <br />the setback from the ordinary high water level. <br />C. The deck encroachment toward the ordinary high water level does <br />not exceed fifteen (15) percent of the existing setback of the <br />structure from the ordinary high water level or does not encroach <br />closer than the shore impact zone, whichever is more restrictive. <br />D. The platform encroachment' toward the ordinary high water level <br />�.. does not encroach closer that thirty (30) feet and does not exceed <br />four hundred (400) square feet in size. <br />E. The deck is constructed-, <br />,primarily of wood, and is not roofed or <br />screened. <br />F. The deck does not exceed ten (10) feet in height, from ground level <br />and must not exceed eight (8) feet above grade, which is <br />determined to be at the foundation; and cannot occupy an area <br />greater than 250 square feet. <br />G. A deck or platform addition shall not be allowed on accessory <br />nonconforming structures. <br />All members voted "aye ".
