OR CITY OF PEQUOT LAKES COUNTY OF CROW WING STATE OF MINNESOTA RESOLUTION NO. 10- A RESOLUTION VACATING A PORTION OF FRONT STREET THE CITY COUNCIL OF THE CITY OF PEQUOT LAKES, MINNESOTA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council previously passed Resolution No. noting its interest \.. in vacating pursuant to Minnesota Statute §412.851 a portion of Front Street located between State Highway 371 and the South line of the SE 1/4 NE 1/4 and the South line of the SW 1/a NE 1 /4, Section 10, Township 136 North, Range 29 West legally described as: Legal Description and Sketch Drawing attached hereto as Exhibit A and setting a public hearing to consider the vacation of such street; and WHEREAS, a public hearing to consider the vacation of such street was held on the day of April, 2010, before the City Council in the City Hall located at 4638 County Road 11, Pequot Lakes, MN at .m. after due published and posted notice had been given, as well as personal mailed notice to all affected property owners by the City Clerk on the day of March, 2010 and all interested and affected persons were given an opportunity to voice their concerns and be heard; and WHEREAS, any person, corporation or public body owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such a way or portion thereof vacated to maintain, repair, replace or otherwise attend thereto; and WHEREAS, the Council in its discretion has determined that the vacation will benefit the public interest because Front Street no longer provides a connection to State Highway 371 and is also not paved.
