docking plan has been submitted. Each individual lot would have the right to have a <br /> dock on Mayo Lake. The docking will likely be consolidated into the area of high <br /> ground, approximately ioo feet to �5o feet in width. Mr. Freiermuth then inquired if <br /> that meant 5 docks on one lot, not one dock per lot. Mr. Burslie stated the DNR has <br /> reviewed the application and has approved the docking concept. Chair Hallan stated <br /> there will be 5 property owners and each lot will be allowed a dock. Mr. Freiermuth <br /> asked what would stop them from making a road and a parking lot. Chair Hallan stated <br /> the wetland is an issue and the DNR wouldn't allow the wetland to be filled. <br /> Timothy Siegel, �6T7 Banning Way, Inver Grove Heights, MN— Mr. Siegel questioned <br /> what the setback would be from his adjacent property. Mr. Burslie stated a io-foot side <br /> yard setback. Mr. Siegel was not happy with the proposed subdivision. <br /> PUBLIC COMMENT CLOSED. <br /> Chair Hallan stated Tract D from the previous Rezone request will be consolidated with <br /> this parcel. The zoning is now Shoreline Residential and the addition of Tract D would <br /> also be Shoreline Residential. The Base Flood Elevation(BFE) doesn't change the basic <br /> characteristics of the property. There is a drainage easement needed across Lot 1. Who <br /> is responsible for putting the culvert in? How does the City ensure it is installed? Mr. <br /> Burslie stated this should be a condition and outlined in the documents. <br /> Mr. Siegel asked when excavation would start. Mr. Peterson stated when a lot would <br /> sell. <br /> Mr. Freiermuth stated there is nothing to keep them from building a road across the <br /> wetland. Chair Hallan stated.a1151ot owners would have to agree since they all own <br /> Outlot A. In addition,they wottld need wetland approval from the State. Mr. Burslie <br /> stated roads are not allowed in the 75-foot setback,just a path. Mr. Freiermuth asked if <br /> each lot would have access from Hurtig Road. Mr. Burslie stated each lot needs access <br /> to Hurtig Road. <br /> A motion was made by Planning Commission Member Mortenson, seconded <br /> by Planning Commission Member Norton, to recommend the City Council <br /> approve the Preliminary Plat of Charliewood, based on the following <br /> Findings of Fact: <br /> 1. The applicant is proposing to subdivide property located along Hurtig Road into <br /> five residential lots and one outlot. <br /> 2. The property is currently zoned"Shoreline Residential". <br /> 3. The land is properly zoned in its natural state for the intended residential <br /> purposes. <br /> 4.
