Section 17-5.9 URBAN RESIDENTIAL (UR) <br /> C. Fences. Fences not exceeding 72 inches in height may be <br /> constructed in the side yard or the front yard of a property. Fences <br /> not exceeding 96 inches may be constructed in rear yard of a <br /> property. Under no circumstances shall a fence be constructed <br /> closer than 10 feet from the surface of a public road and in all <br /> cases not within the public right-of-way. Materials shall consist of <br /> usual fencing materials with posts and fence of inetal,wood, <br /> concrete,brick or smooth wire. Barbed or electrified wire is <br /> prohibited, except where specific approval has been given by the <br /> Planning Commission. <br /> Section 17-5.12 DOWNTOWN MIXED USE (DMiJ) <br /> D. Fences. Fences not exceeding 72 inches in height may be constructed. <br /> Fencing sha11 only be constructed closer than 10 feet from the <br /> surface of a public road with the permission of the Planning <br /> Commission and in all cases not within the public right-of-way. <br /> Materials shall consist of usual fencing materials with posts and <br /> fence of inetal,wood, concrete,brick or smooth wire. Barbed or <br /> electrified wire is allowed only with the permission of the Planning <br /> Commission. <br /> Staff Findings: Staff provides the following Findings of Fact for consideration <br /> by the Planning Commission: <br /> i. The amendment creates a performance standard that promotes an urban <br /> development pattern. <br /> Planning Commission Direction: The Planning Commission recommend <br /> approval the ordinance amendment, recommend denial the amendment, or table <br /> the request if additional information is needed. If the motion is for approval or <br /> denial,findings of fact should be cited. <br /> Staff Recommendation: We recommend a motion for the City Council to <br /> Amend the Ordinance. <br /> Pequot Lakes Staff Report 3(d)-2 <br /> February i5,2oi� <br />
