��a� <br /> �'��qu�t <br /> L�k��=- <br /> NEW BUSINFSS—FENCE HEIGHT <br /> Agenda Item: �(b) <br /> Background Information: In June, 20�6 the Ordinance was amended for <br /> fence height in the front yards from 6o inches to �2 inches in the Rural <br /> Residential, Shoreline Residential, Shoreline Commercial, Transition Residential <br /> and Urban Residential zoning classifications. Wooden fence panels were not <br /> available at Menards, Fleet Farm or Home Depot at 6o inches (5 feet). <br /> In July a property owner applied for and received a Land Use Permit to construct <br /> a fence not to exceed�2 inches in height. Please review the attached photographs <br /> depicting the conditions at this property from June through October. <br /> Applicable Regulations: <br /> Section 17-5.9 URBAN RESIDENTIAL (URl <br /> C. Fences. Fences not exceeding 72 inches in height may be <br /> constructed in the side yard or the front yard of a property. Fences <br /> not exceeding 96 inches may be constructed in rear yard of a <br /> property. Under no circumstances shall a fence be constructed <br /> closer than 10 feet from the surface of a public road and in all <br /> cases not within the public right-of-way. Materials shall consist of <br /> usua.l fencing materials with posts and fence of inetal,wood, <br /> concrete, brick or smooth wire.
