CITY OF PEQUOT LAKES RESOLUTION 17-18 � FINDINGS,CONCLUSIONS AND ORDER OF PEQUOT LAKES CITY COUNCIL REGARDING ALLEGED CODE VIOLATIONS AND NUISANCE CONDITIONS AT 3952 COUNTY ROAD 17 WHEREAS, notice pursuant to Pequot Lakes City Code ("City Code") Section 7-2.6, notice of the hearing before the City Council ("City Council") of the City of Pequot Lakes Minnesota.("City"),to consider the alleged code violations and nuisance conditions at 3952 County Road 17, Pequot Lakes, Minnesota(the"Property"), was duly given to Virgil Dahl, property owner of record of the Property, by U.S. Mail on Apri121,2017; and WHEREAS,the City entered into an agreement with the property owner of the Property on July 7, 2016 pursuant to which the property owner agreed to remedy specified code violations on the Property in connection with the property owner's application for a building permit to improve the dwelling unit on the Properiy; however the property owner has not completed the corrective actions specified in such agreement. WHEREAS,pursuant City Code Section 7-2.6, a public hearing was held on June 6, 2017, before the City Council to consider the alleged code violations and nuisance conditions present on the Property, and a list of those individuals testifying at the public hearing is attached hereto as E�chibit A. � NOW, THEREFORE,the Pequot Lakes City Council, based upon the record and evidence presented at said hearing, makes the following: FINDINGS 1. T'hat Virgil Dahl is the ovtmer of record of the Properiy, according to Crow Wing County's records as attached hereto as Exhibit B. 2. That the property owner of record received written notice of the alleged code violations and nuisance conditions and of the June 6,2017 public hearing thereon, as shown in the correspondence attached hereto as Earhibit C. 3. That garbage,junk, lumber, scattered fencing materials, a dilapidated structure near the fire pit, inoperable motor vehicles, a fifth-wheel trailer with a makeshift wall, metal pieces and other debris have been allowed to accumulate and are currently present in plain view on the premises of the Property. 4. That the accumulation of such garbage,junk, lumber, fencing materials, dilapidated � structure, inoperable motor vehicles,trailer,metal pieces and other debris on the � premises of the Property is in violation of the following City Code Sections (prohibited conditions in parentheses following citation): � � �.: � i i � � I
