- CITY OF PEQUOT LAKES <br /> �.- RESOLUTION 17-10 <br /> RESOLUTION RELATED TO THE JURISDICTIONAL TRANSFER AGREEMENT <br /> BETWEEN CROW WING COUNTY AND THE CITY OF PEQUOT LAKES <br /> FOR SEGMENTS OF CSAH 11, CR 112, AND STATE HIGHWAY 371 <br /> BETWEEN CR 107 AND CSAH 17 <br /> WHEREAS, Crow Wing County (County) and the City of Pequot Lakes (City) entered <br /> into the Agreement referenced above with the final signature on said Agreement being <br /> dated 12/15/15, and <br /> WHEREAS, Section VII. Pavment in Lieu of Construction, of the Agreement identifies <br /> payment requirements and Environmental Site Assessment (ESA) obligations of the <br /> County, and <br /> WHEREAS, the Agreement states that the County shall be responsible for a Phase I <br /> ESA to be perFormed, a Phase II ESA (if needed), obtaining "No Association <br /> Determinationn documentation (if needed), and negotiating mitigation of contaminated <br /> sites (if needed) to complete the requirements of the Agreement, and <br /> l WHEREAS, the County has completed the Phase I ESA and Phase II ESA, with a <br /> �" determination that obtaining �No Association Determination" documentation is not <br /> needed, which also indicates that mitigation of contaminated sites is not needed, and <br /> WHEREAS, the results of the ESA were provided to and discussed with the City. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PEQUOT <br /> LAKES, MINNESOTA that all Environmental Site Assessment obligations identified in <br /> the Jurisdictional Transfer Agreement have been met and there is not a need to obtain <br /> "No Association Determination" documentation and not a need for future mitigation of <br /> any the sites included in the study area. <br /> Adopted by the City Council of the City of Pequot Lakes this 4th day of April, 2017. <br /> Z� � �� <br /> Nancy A.
