Mr. Burslie explained one reason to vote against adopting had been cost, and the other <br /> being all construction in the City is required to be built to Code and that is the <br /> responsibility of the properry owners and building contractors to be built to that Code. <br /> The Planning Commission didn't feel permits should be required for roofing, siding, or <br /> windows. <br /> Council Member Akerson inquired if there is someone who can enforce or inspect <br /> without adopting the Code. Mr. Burslie stated the City issues Land Use Permits. We <br /> look at the type of use,location, setbacks, impervious coverage and height. There are no <br /> plan reviews. Property owners can hire any state licensed inspector,but there is no <br /> enforcement through the City. <br /> Planning Commission Member Wallin asked if a licensed contractor had not built to <br /> Code,is there any recourse against the builder. Mr. Burslie stated through the court <br /> system there is recourse. <br /> Mr. Burslie introduced Scott Sadusky who is a licensed State Building Inspector. Mr. <br /> Sadusky has attended earlier Planning Commission meetings to provide information. <br /> Council Member Pederson asked if a new building was constructed by a licensed <br /> contractor,was inspected by a licensed inspector,who is liable if a mistake is later <br /> found. Mr. Sadusky stated the contractor would be liable, not the inspector. The <br /> inspector is not present�00%of the time and do not guarantee everything. <br /> Council Member Pederson then inquired if quality housing is what we need,are there <br /> contractors in town today building non-quality homes? Mayor Adams responded that <br /> there are. Council Member Pederson then commented the Gull Lake and Cross Lake <br /> don't enforce the State Building Code but they have million dollar homes being built. <br /> Planning Commission Member Mortenson stated those homes are being built by <br /> reputable contractors. <br /> Planning Commission Member Hallan stated he has conducted inspections on many <br /> houses in the Cross Lake area where homes were not built to code and homeowners <br /> spent tens of thousands in repairs and attorney fees. Ninety-five out of ioo are built <br /> fine,but there is never a guarantee. <br /> Planning Commission Member Hallan further stated that if you adopt the State Building <br /> Code and you do not have a good enforcer,then why have it. <br /> Mayor Adams stated that there has been a reoccurring concern that by adopting the <br /> State Building Code with its additional costs will suppress building activity.
