03 Consider Adopting an Order Declaring Property to be a Public Nuisance

City's Code of�rdinances and nuisance regulations(the"City Code") despite receiving numerous previous written and verbal notices af violatian from the City. This letter is intended to provide you notice of the City Code violations and nuisance conditions that continue on the Property and the corrective action that is necessary for you to avoid additional enforcement action against you. Violations of City Code and Nuisance Conditions The accumulation of miscellaneous junk,construction materials,brush/branches, and other debris on the Property is in violation of the following City Code provisions: • Section 1�-7.4 requires"(a)11 structures shall be properly maintained in a clean and accepta.ble manner so as not to constitute a menace to the public health, safety,convenience,general welfare,property values,and aesthetics" . . . . and that"(a)all landscaping shall be properly maintained so as to preserve planting in a live state and free of no�cious weeds." • Section 1�-7.5 (B� requires that"all materials and equipment shall be stored within a building or fully screened so as not to be visible from adjoining properties." • Section i7-7.6 prohibits land uses that have"a strong negative visual impact or offends the morals or violates the standards of the City." • Section 17-�.�requires that"(a�ll solid waste shall be disposed of in accordance with the standards of Crow Wing County. In addition,the conditions on your property described above constitute a public nuisance under the following provisions in Chapter�.2 of the Code,which provides that anyone who maintains such conditions is guiity of a misdemeanor: • Any condition"which unreasonable annoys,injures,ar endangers the safety, health,morals,comfort,or repose of any considerable number of inembers of the public(City Code�-2.i); • Accumulatians of manure, refuse,or other debris(City Code�-2.2); • Accumulations in the open of discarded or disused machinery,household appliances,automobile bodies,or other material,in a manner conductive to the harboring of rats, mice, snakes,or vermin, or the rank growth of vegetation among the items so accumulated,or in a manner creating fire,health,or safety hazards from such accumulation(City Code�-2.4); • All other conditions or things which are likely ta cause injury to the person or property of anyone(City Code 7-2.4).
