Derksen VIA PERSONAL SERVICE 31116 Ash Street Pequot Lakes, MN 56472 Re: NOTICE— IMMEDIATE CORRECTIVE ACTION REQUIRED City Ordinance Violations at 31116 Ash Street,Pequot Lakes,MN 56472 Dear Mr. and Mrs. Derksen: I am writing in my capacity as Zoning Specialist for the City of Pequot Lakes (the"City") concerning the status of the code violations and public nuisance conditions on your above-referenced property located at 31116 Ash Street(the"Property"). Initially, please be advised that the City Council voted at its June 6, 2017 meeting to rescind its previous approval (on May 2, 2017) of an agreement with you for the removal of code violations and nuisance conditions on your property on the grounds that the City Council was misinformed the agreement's contents when it approved the agreement, and there was no agreement between the parties to the contract about its essential terms (i.e.the council believed it was retaining its right to charge any eventual costs it incurs in performing any of the specified corrective actions that you fail to perform after due notice as an assessment against your property,whereas the markup presented to the City Attorney immediately prior to the meeting removed the language authorizing such an assessment). The City Council took no further action with respect to your property at its June 6, 2017 meeting. I am writing now to again notify you that there are conditions remaining on the Property that violate the City's Code of Ordinances (the "City Code") and which constitute a public nuisance that must be addressed to bring your property into compliance. Specifically,there remains miscellaneous junk, construction materials,brush/branches, furniture, and other debris accumulated in plain site on the Property in violation of the 1 "This institution is an equal opportunity provider and employer"
